Restricted Access to Public Information on Nonbank Financial Institutions for Duration of Martial Law

In order to prevent illegal use by the aggressor of public information on participants of the nonbank financial market of Ukraine and enhancing security, the NBU has restricted access to such information for the duration of martial law.

By doing so the regulator restricted access for users to data from individual registers and lists. In particular, they include the State Register of Financial Institutions, the Collection Agency Register, the State Register of Insurance and Reinsurance Brokers, the List of Nonbank Financial Groups, etc.

In addition, access to the comprehensive informational system of the NBU (hereinafter referred to as the CIS NBU) is also restricted. Access to this system will be granted to authorized financial service providers of the CIS NBU.

During martial law the information on ownership structure of financial service providers and collection agencies will not be published on the NBU’s official website. Access to such information published before 22 April will be denied. Legal entities and individuals of Ukraine can receive this data according to a defined procedure.

Nonbank financial institutions, nonfinancial legal entities, and collection agencies are not obligated to release data on the ownership structure on the websites for the duration of martial law.

The relevant amendments are stipulated in NBU Board Resolution No. 77 On Amendments to Resolution of the Board of the National Bank of Ukraine No. 39, dated 6 March 2022, dated 20 April 2022 (hereinafter referred to as the Resolution).

The Resolution comes into effect on 22 April 2022.

User access to information in registers, lists, the CIS NBU, and information on ownership structure of financial service providers and collection agencies will be restored within five business days as of lifting or cancelling martial law in Ukraine.

The Resolution was prepared in compliance with Presidential Decree No. 64/2022 On Introducing Martial Law in Ukraine dated 24 February 2022 adopted by Law of Ukraine No. 2102-IX On Approval of the Presidential Decree On Introducing Martial Law in Ukraine,  dated 24 February 2022.
