Kyiv District Administrative Court Confirms NBU’s Proper Supervision of Platinum Bank PJSC

On 17 October 2018, the Kyiv District Administrative Court denied in full the claim filed by depositors of Platinum Bank PJSC S.I. Zhukovskyi and N.V. Zhukovska against the National Bank of Ukraine (NBU) on illegal omission regarding failure to protect the legal interests of depositors and creditors the said bank.

Having closely studied the case files the Kyiv District Administrative Court has ruled for the NBU i.e. that  the regulator conducted proper bank supervision of Platinum Bank PJSC.

Courts have repeatedly ruled that the NBU appropriately supervised banks that were later shut down as insolvent.

In 2014–2018, the NBU won 69 lawsuits contesting the central bank’s omission with respect to banks that were declared insolvent or liquidated. At the same time, 88 lawsuits are still being considered by courts of various instances.

Please be reminded, that Platinum Bank PJSC was declared insolvent on 10 January 2017 due to capital shortage.
