On 16 March 2016, the Primorsky District Court of Odesa ruled to collect from Mr Klimov UAH 309 million and UAH 850.67 thousand in loan debt under the stabilization loan agreement between the National Bank of Ukraine and Imexbank PJSC in favor of the NBU.
In the current ruling, the Court also ordered Mr Klimov to reimburse UAH 4.6 million million in legal fees to the NBU.
As reported by the Primorsky District Court of Odesa in its report, on 15 March 2016, the court satisfied the claim filed by the NBU and seized the residential house, the apartment in Odesa, the Mercedes motor vehicles, and the parking slots in Odesa owned by Mr Klimov. Additionally, the shares of several companies were seized by the court, including those held by FC Chornomorets, which is the beneficial owner of these companies. This move will facilitate the execution of the court's decision should the latter enter into force.
The stabilization loan agreement was entered into between the NBU and Imexbank PJSC on 28 November 2014. Mr Klimov acted as a guarantor under the loan agreement. However, neither the bank nor the guarantor met their obligations under the loan agreement.
On 26 January 2015, the NBU adopted a decision to declare the bank insolvent due to its poor financial standing. Additionally, the NBU detected the operations performed by the bank in violation of the regulator’s requirements and NBU regulations, including operations involving early repayment of subordinated debt, which led to a substantial reduction in the bank’s capital and a marked deterioration in its liquidity position. On 21 May 2015, the NBU revoked the banking license from the bank.
