The National Bank of Ukraine informs that public that the open bidding procedure for the provision of legal services was conducted through PROZORRO on 13 February 2017. 19 companies participated in the bidding procedure. This being said the bids were automatically assessed by PROZORRO based on the single criterion "price".
Based on the estimation results, the bid submitted by Vagomyi Argument LLC was the most cost-efficient as this company offered the lowest price - 59.90 UAH for services requested by the central bank.
Following the evaluation of the bids, the NBU Bidding Committee carried out an assessment to determine whether the documents submitted by the eligible bidders meet the qualification criteria, starting from the bidder that submitted the most cost-efficient bid.
Following the review of the bid submitted by Vagomyi Argument LLC, on 16 February 2017, the NBU Bidding Committee adopted a decision (Minutes No. 60/17 of 16 February 2017) to reject this bid as the documents failed to meet the qualification criteria. In particular:
- the bidder failed to submit copies of diplomas, certificates, including at least three certificates allowing its holder to provide advocacy services, other documents in the established form confirming the qualification of all the specialists employed by the bidder and mentioned in the above certificate;
- the certificate confirming the availability of employees/partners that meet the qualification requirements, and have the necessary knowledge and experience indicated neither education nor legal specialization areas;
- the certificate confirming experience in executing similar contracts did not indicate the results or progress in the delivery of services; - the bidder failed to submit a VAT tax payer's certificate, an extract from the Registry of VAT taxpayer - for the participant that are liable to pay VAT single tax; a certificate for single taxpayers or an extract from the Single tax payers registry; and
- The bid was not executed in a proper manner.
Following the review of the bids, it was established that the bi submitted by Gvozdiy and Oberkovych Law Firm (next on the list ) was the most cost-effective and it met the qualification requirements set for documents. The NBU Bidding Committee named this law firm as the winner of the open bidding procedure. nder
In accordance with the requirements set for bidding documents and the Law of Ukraine On Public Procurement, the winner is required to publish a notification of intent to enter into an agreement within five days and submit documents confirming the absence of grounds mentioned in Article 17 of this law. If the bidder fails to submit these documents, the bid will be rejected.
According to the annual procurement plan of the NBU for 2017 published on the websites of the regulator and PROZORRO, the NBU intends to procure legal services in three lots:
- Lot 1 - representation and legal defense of the interests of the NBU in courts of different instances in labor disputes;
- Lot 2 - representation and legal defense of the interests of the NBU in courts of different instances in cases in cases involving the protection of honor, dignity and business reputation;
- Lot 3 - representation and legal defense of the interests of the NBU in courts of different instances in cases related to banking supervision and financial monitoring issues
