In order to implement the requirements set forth in the Law of Ukraine “On Households Deposit Guarantee System” of 23 February 2012 No. 4452-VI, which came into effect on 22 September 2012, the Board of the National Bank of Ukraine adopted Resolution No. 362 (registered with the Ministry of Justice of Ukraine on 21 September 2012 under No. 1633/21945) amending the Instruction on the Interbank Transfer of Funds in Domestic Currency in Ukraine approved by NBU Board Resolution No. 320 of 16 August 2006 registered with the Ministry of Justice of Ukraine on 6 September 2006 under No. 1035/12909.

In particular, the amended Instruction stipulates the procedure to be carried out by the National Bank of Ukraine for the indisputable write-off of funds placed on the bank correspondent account to settle the bank’s fee arrears and accrued penalty fees with the Household Deposit Guarantee Fund.

The norms concerning the procedure for execution of the payment request for the mandatory write-off of the bank’s funds and documents regarding the freezing of the bank’s funds during the moratorium on the creditors’ claims satisfaction have been excluded from the Instruction. The amended Instruction establishes the procedure for execution of the payment request for the mandatory write-off of the bank’s funds and documents regarding the freezing of the bank’s funds when the Household Deposit Guarantee Fund appoints the provisional administration to the bank.
