By virtue of Resolution of the Cabinet of Ministers of Ukraine "On Amending Item 3 of the Procedure for Determining the Terms and Conditions Governing the Completion of an Import Transaction without Bringing in Commodities to the Customs Territory of Ukraine” No. 1009 of 29 October 2012, the Cabinet of Ministers of Ukraine has clarified the list of conditions under which import transactions carried out by residents shall be deemed complete.
In particular, if the commodity that was to be imported is sold to the non-resident outside the customs territory of Ukraine, an import transaction that takes place without bringing in the commodity to the customs territory of Ukraine shall be deemed complete after the proceeds from sale that are received exclusively from the non-resident are entered in the account.
This means that the receipt of funds from another resident of Ukraine under such a transaction does not provide any grounds for completing an import transaction without bringing in the commodity to the customs territory of Ukraine and lifting control on it pursuant to the Instruction on the Procedure for Exercising Control over Export and Import Transactions approved by NBU Board Resolution No. 136 of 24 March 1999 (amended).
