Due to amendments to Ukrainian legislation the NBU developed the draft resolution of the NBU Board On Amendments to Some Regulatory Documents of the National Bank of Ukraine (hereinafter - the Draft).

Draft shall regulate the following issues:

• banks’ implementation of measures regarding arrest of funds on customers’ accounts under private contractors resolution on arrest of funds;
• receipt by banks of requests for forced debiting of funds executed by private contractor;
• banks’ implementation of measures regarding arrest of funds on customers’ accounts pursuant to decisions of investigating judge and court made within the process of criminal prosecution, and debiting funds on grounds of request for payment executed by the National Agency of Ukraine for identifying, tracing and management of assets derived from corruption and other crimes, which is authorized to manage such funds;
• banks’ notice to private contractor regarding opening of new account by customer, who is registered as such that is having encumbrances of moveable property;
• banks’ opening of accounts for minors subject to passport of citizen of Ukraine. 

Moreover, the Draft proposes other amendments to improve the procedure for servicing banks corresponding accounts in national currency and performing cashless settlements in national and foreign currencies.

The amendments are planned to the Instruction on the procedure of opening, usage and closing of accounts in domestic and foreign currencies approved by the NBU Board Resolution No. 492 of 12 November 2003 registered by the Ministry of Justice of Ukraine on 17 December 2003 under No. 1172/8493 (amended) , Instruction On the cashless payments in Ukraine in domestic currency approved by the by NBU Board Resolution No.22 of 21 January 2004 registered by the Ministry of Justice of Ukraine on 29 March 2004 under No. 377/8976 (amended), Instruction On the interbank money transfer in Ukraine in domestic currency, approved by the by NBU Board Resolution No.30 of 16 August 2006  registered by the Ministry of Justice of Ukraine on 6 September 2006 under No. 1035/12909 (amended), Regulations on the Procedure of Banks’ Exercising Remittance Documents, Forced Writing-off and Arrest of Funds in Foreign Currencies and Precious Metals approved by NBU Board Resolution No. 216 of 28 August 2008 registered by the Ministry of Justice of Ukraine on 1 October 2008 under No. 910/15601 (amended).
