Almost 4,000 borrowers engaged in active military service requested banks to review the terms of loan agreements

The banks have already considered 3, 934 requests from the borrowers engaged in active military service asking banks to grant them a delay in payment of interest due under the loan agreement. According to the information submitted to the regulator by banks as of July 16, 2014, the terms of 3,560 (90.5%) loan agreements have been reviewed.

In a letter of July 28, 2014, the National Bank of Ukraine reminded banks of the requirement to strictly comply with the Ukrainian laws, and follow recommendations provided by the regulator, and warned them that non-compliance with the legal requirements constitutes grounds for applying enforcement measures to the law breakers.

When analyzing requests filed to the National Bank of Ukraine with regard to the problems related to the need to ensure banks' compliance with the applicable laws, it should be noted that ensuring greater effectiveness of communication between the military servicemen, the Ministry of Defence of Ukraine, the Ministry of Internal Affairs of Ukraine, the Security Service of Ukraine, and banks is one of the most important tasks. This issue is currently being addressed.

The Law of Ukraine “On Amendments to Some Laws of Ukraine with regard to the Improvement of Defense and Mobilization Issues during Mobilization” came into force on June 8, 2014. In this regard, the Law of Ukraine “On Social and Legal Protection of Military Servicemen and Members of their Families" has been amended to include certain provisions. The amended Law grants relief from penalties and fines for the failure to meet the obligations to enterprises, institutions and organizations of all forms of ownership, including banks and natural persons, and relief from payments of interest due under the loans to military servicemen for the duration of the special period and army reservists and reservists liable for call-up for the period spanning from the moment when a call-up is announced until the end of the special period.
